El Salvador’s Temporary Protected Status (TPS) designation and related benefits are set to terminate on September 9, 2026. With fewer than four weeks remaining, USCIS has announced an emergency clarification on work authorization extensions for beneficiaries whose EAD renewal applications remain pending.
What changed
USCIS is sending notices to El Salvador TPS recipients who continue to be eligible for TPS but haven’t received renewal EADs with category codes A-12 or C-19 and whose TPS-based EAD application is still pending, informing them that their expired TPS-based EADs are extended until September 9, 2026.
The notice also clarifies how employment authorization will be verified in the E-Verify and SAVE systems during the terminal period. TPS beneficiaries will receive a SAVE response of “Temporary Protected Status – Employment Authorized - Temp Emp Auth,” with an employment authorized through date corresponding to the EAD expiration date of September 9, 2026.
Why it matters
This announcement solves a critical work-authorization gap for the approximately 230,000+ Salvadoran TPS beneficiaries caught between application processing delays and the September 9 termination date. Without this clarification, beneficiaries whose EAD renewals were submitted during the 2025 re-registration period (January 17–March 18, 2025) but not yet adjudicated would lose work authorization on the card expiration date, even though their underlying TPS remains valid through the termination date.
The SAVE/E-Verify update ensures that employers and government agencies recognize these individuals as work-authorized during the final transition period, preventing premature employment disruptions. However, this extension is temporary and does not extend the TPS designation itself—only the employment authorization validity for those with pending EAD renewals.
Way forward

Verify pending EAD status now. If you represent a TPS beneficiary from El Salvador, check USCIS online case status immediately. If the I-765 EAD application has not yet been approved or denied, the auto-extension applies.

Confirm SAVE/E-Verify record updates. Advise clients that their employer should see the corrected “Temporary Protected Status – Employment Authorized” indicator in the employment verification system. If SAVE shows an expired card date, request a manual SAVE verification review.
